Summary: A Power of Attorney for court case lets a lawyer or trusted representative file claims, attend hearings and sign pleadings on your behalf before Dubai Courts. This guide explains what the document must contain, how long it stays valid, what determines its cost, how to obtain it through Dubai Courts or a licensed private notary service, and how the whole process can be completed online — usually within one working day. The POA is always notarised by the Dubai Courts Notary Public; Private Notary Dubai drafts, translates and manages the process for you.

Legal notice: The information in this article is general and educational and does not constitute legal advice. Requirements may vary depending on your case and the competent authority, and final acceptance of any document rests with the court or authority to which it is submitted. Consult a licensed lawyer about your specific dispute.

Why a Power of Attorney for Court Case Matters in Dubai

Legal disputes are demanding at the best of times — and far harder when you cannot be in the courtroom. If you live abroad, travel frequently, run several businesses or simply prefer to keep your distance from the proceedings, a Power of Attorney for court case is the instrument that allows someone else to act for you with full legal effect.

Under the UAE Civil Procedure Law (Federal Decree-Law No. 42 of 2022), a lawyer cannot file a claim, submit a defence or plead before the court on behalf of a client without a duly notarised power of attorney. Dubai Courts check this document at the first hearing, and a missing, expired or vaguely worded POA is one of the most common reasons a hearing is adjourned. From our daily casework, most delays in the first weeks of litigation trace back to the POA rather than to the merits of the case.

In this guide we cover what a court case POA is, the types available, the legal requirements, its validity period, what determines the cost, the two routes to obtain it, a real case study, and answers to the questions clients ask us most often.

What Is a Power of Attorney for Court Case?

A Power of Attorney for court case is a notarised legal document by which one person (the principal) authorises another (the agent — usually a licensed advocate) to represent them in legal proceedings. In the UAE, litigation representation before the courts is reserved for advocates registered with the Ministry of Justice or the relevant local judicial authority, so the agent named in a litigation POA is in practice your lawyer. For the general concept, see our explainer on what a power of attorney is and the difference between agent and principal.

Depending on how it is drafted, the POA typically covers:

  • Filing lawsuits, counterclaims and appeals
  • Responding to claims and submitting defences, memoranda and evidence
  • Appearing at hearings, expert meetings and mediation sessions
  • Signing pleadings, settlement agreements and enforcement requests
  • Receiving judgments and notifications on the principal’s behalf

Types of Power of Attorney for Court Case in Dubai

General litigation POA

Authorises the lawyer to represent you in any current or future case before the UAE courts, at every level (first instance, appeal, cassation) and in enforcement. Suits business owners and investors with recurring disputes. Compare with a litigation power of attorney in the UAE.

Specific court case POA

Limited to one named dispute — identified by case number, court and opposing party. Ends when that case concludes. Preferred where the principal wants tight control over scope. Read about special powers of attorney in the UAE.

Either type can be granted by an individual or by a company (through its authorised signatory). For corporate litigants, see corporate power of attorney in Dubai; for private individuals, individual power of attorney in the UAE. A full overview of categories is in our complete guide to types of power of attorney.

Why You Might Need a Court Case POA in Dubai

Dubai’s international population and fast-moving commercial environment make the court case POA one of the most frequently notarised documents we handle. Typical situations:

Acting without a POA carries its own dangers — a lawyer who cannot prove authority will have filings rejected. Our article on the risks of having no power of attorney explains the consequences.

Power of Attorney for Court Case in Abu Dhabi and Sharjah

This guide follows the Dubai framework, where the POA is notarised through the Dubai Courts Notary Public. In Abu Dhabi notarisation falls under the Abu Dhabi Judicial Department (ADJD); in Sharjah under the Sharjah Judicial Department; in Ajman, Fujairah and Umm Al Quwain under the Ministry of Justice; and in Ras Al Khaimah under RAK Courts. The legal effect is identical across the UAE, but forms, booking channels and identity checks differ by emirate. Private Notary Dubai coordinates the process for clients in every emirate, with the final notarisation always performed by the competent authority.

Legal Requirements for a Court Case POA in Dubai

Essential Elements of a Power of Attorney for Court Case

For the Notary Public to attest the document and for Dubai Courts to accept it, the POA must contain:

  • Full legal names, nationalities and Emirates ID or passport numbers of principal and agent — identity is verified at notarisation (see principal and agent identity verification)
  • The specific powers granted, listed expressly — not “all powers”. The notary and the courts read the document restrictively; see powers of attorney and their limits
  • Duration and territorial scope (Dubai / UAE courts)
  • Clear reference to the court matter — case number, court, parties and subject of the dispute
  • For a company principal: trade licence, memorandum of association and proof that the signatory is authorised — see authorised signature requirements

Sample Power of Attorney for Court Case: What the Template Looks Like

Clients often ask for a “power of attorney for court case template”. A compliant draft in Dubai always follows the same skeleton, whatever the dispute:

1. The parties

Principal and appointed lawyer — full name, nationality, ID or passport number, address.

2. The case reference

Court, case number if filed, opposing party and subject — or a defined scope if not yet registered.

3. The powers granted

Filing, defending, attending hearings, submitting evidence, appealing, settling or waiving — each listed expressly.

4. Term, date and notarisation

Validity period or “until conclusion of the case”, place and date of signing, and the Notary Public attestation block.

Important: a downloaded sample has no legal effect on its own. Dubai Courts accept only the wording approved and notarised by the Notary Public — the official form is produced at notarisation, not copied from the internet. Our guide to proper legal drafting of a power of attorney explains why wording matters.

Language and Translation

Arabic is the official language of the UAE courts. A POA drafted in English or another language must be accompanied by a certified legal translation from a translator licensed by the Ministry of Justice, and the notary attests the Arabic text. We arrange English–Arabic legal translation as part of the service; for background, see the importance of legal translation in the UAE.

Notarization Process for a Court Case POA

Notarisation is performed by the Dubai Courts Notary Public under Dubai Law No. 4 of 2013 regulating the Notary Public. In practice the process with our team is:

  • Contact our team and share the case details.
  • Send the required documents (IDs, case reference, company papers if applicable).
  • Meet the notary online by video call, or at your location through our mobile notary service.
  • Receive the notarised POA electronically, ready for your lawyer to submit.

For a step-by-step look at the attestation itself, read how to notarize a POA in the UAE and issuing a POA through a UAE notary public.

How Long Does a Power of Attorney for Court Case Last in the UAE?

There is no single statutory validity period. The duration is whatever the document states, and the agency provisions of the Civil Transactions Law (Federal Law No. 5 of 1985) fill the gaps:

  • Fixed term stated in the POA — the most common option; many litigation POAs are drafted for one to three years and renewed if the case runs longer.
  • No term stated — a specific court case POA remains effective until the case it names is concluded, or until it is formally revoked.
  • Automatic termination — the POA lapses on completion of the case, death or loss of capacity of the principal, resignation or removal of the lawyer, or a notarised revocation. See what happens to a POA on the death of the principal or agent.
  • Practical tip — review the POA whenever you change lawyers, the case moves to appeal or cassation, or the dispute runs well beyond the original estimate. Dubai Courts will not accept pleadings from a representative whose POA has expired.

The general rules are covered in power of attorney validity conditions in the UAE. To end a POA early, a legal notice for cancellation of power of attorney is served on the agent.

Power of Attorney for Court Case Cost in Dubai: What Determines It

“How much does a power of attorney cost in the UAE?” has no single answer, because the total is made up of separate items — some official, some service-based:

Cost componentWho sets it
Notary Public attestation feeDubai Courts official fee schedule — varies by document type and number of copies
Certified legal translation into ArabicLicensed legal translator, charged per page — only if the source is not in Arabic
Drafting and case-management serviceThe service provider — drafting, document checks, booking and follow-up
Signing channelOnline notarisation via video call / UAE PASS and in-person or mobile appointments carry the same official fee but differ in service scope

Official fees are revised periodically, so we do not publish fixed figures here. Contact us with your case details for a current quote, or consult the fee schedule on dc.gov.ae.

Step-by-Step Guide: How to Get a Power of Attorney for Court Case in Dubai

1

Consult your lawyer. Agree which powers the POA must cover — first instance only, or appeal, cassation, enforcement and settlement as well.
2

Send your documents. Emirates ID or passport for both parties, the lawyer’s licence details, the case reference, and company papers if the principal is a company.
3

We draft the POA. Clear legal language, express powers, case references — in Arabic, with a certified translation if you need an English copy.
4

Sign before the notary. By video call with UAE PASS or verified ID, or in person through our mobile notary. The Dubai Courts Notary Public attests the document.
5

Submit to the court. Your lawyer files the notarised POA with the case file and can act from that moment.
Done. Your representative attends hearings and files pleadings on your behalf — you receive updates without setting foot in court.

Timeframe to Get a Power of Attorney for Court Case

With complete documents, a court case POA is typically drafted, translated and notarised within one working day. Where the notary requests corrections, or where a corporate principal’s documents need updating, allow an additional day. Timing of the notary session itself depends on Dubai Courts availability.

How to Create a Power of Attorney Through Dubai Courts

Whichever route you choose, the Power of Attorney for court case ends up notarised by the same authority — the Dubai Courts Notary Public. What differs is who manages the process:

Route 1 — Direct via Dubai Courts

Log in to the Dubai Courts portal or smart app with UAE PASS, upload your own Arabic draft (or a certified translation), pay the official fee and attend a remote or in-person notary session. You are responsible for the wording, the translation and any corrections the notary requests. Residents of other emirates use the Ministry of Justice digital notary or their local judicial department.

Route 2 — Through a licensed private notary service

Private Notary Dubai drafts the POA in Arabic, arranges the certified translation, books the notary session and submits everything on your behalf. You sign remotely or at your location. The document carries exactly the same official attestation — the difference is that drafting and procedure are handled for you, which is why most cases complete within one working day.

More on remote signing: issuing a POA via the smart application, e-notarisation in the UAE and our e-notary Dubai service.

Court Fees vs Notary Fees: Two Different Payments

Clients searching “how much are court fees in the UAE?” often mix up two unrelated costs:

Notary fee — paid to the Dubai Courts Notary Public when the POA is attested. A fixed, per-document fee unrelated to the value of your claim.
Court (judicial) fee — paid separately to the court when the lawsuit is filed, under Dubai Law No. 21 of 2015 on judicial fees. Generally a percentage of the claim value within set minimums and maximums, differing for civil, commercial, labour and personal status cases. Appeals and enforcement carry their own fees.

Your lawyer pays the court fee when filing on your behalf; notarising the POA does not include it. Current judicial fee tables are published by Dubai Courts.

Common Mistakes With a Court Case POA

  • Vague or blanket powers. “All powers” wording is routinely questioned by the notary and the court; every power must be listed.
  • Missing case reference. A specific POA that does not identify the dispute is treated as incomplete.
  • Expired POA at appeal stage. A one-year POA signed at first instance often lapses before the appeal — check the term before every new stage.
  • Uncertified translation. Only translations by Ministry of Justice-licensed translators are accepted; a self-made English version has no standing.
  • Unauthorised company signatory. If the person signing for a company is not named in the licence or a board resolution, the POA is rejected.
  • Using a foreign POA without legalisation. A POA signed abroad must be attested by the UAE embassy and the Ministry of Foreign Affairs before the notary or court will accept it — see power of attorney attestation in Dubai and consular attestation of a power of attorney.

How Private Notary Dubai Helps

Private Notary Dubai is a licensed private notary service. We do not issue the POA — the Dubai Courts Notary Public does — but we manage everything around it:

  • Drafting the Power of Attorney for court case in Arabic with express, court-ready powers
  • Certified legal translation to and from English, Russian and other languages — see Russian legal translation in the UAE
  • Checking company documents and signatory authority before the notary session
  • Booking and attending the online or mobile notarisation with you
  • Coordinating legalisation for clients signing abroad — including from the UK, USA and Canada
  • Related notarial work: certified true copies of evidence and document attestation

Our full range is on the power of attorney services page; general questions are answered in our power of attorney FAQ.

Important notes

  • The POA is notarised by the Dubai Courts Notary Public (or the judicial authority of your emirate); Private Notary Dubai facilitates the process.
  • Final acceptance of the document rests with the court to which it is submitted.
  • Only advocates registered with the Ministry of Justice or the local judicial authority may plead before the courts; a POA does not make a non-lawyer an advocate.
  • Requirements and fee schedules are updated from time to time — confirm current details before proceeding.

FAQs About Power of Attorney for Court Case in Dubai

Is a POA mandatory for court representation?

Yes, if someone else represents you. A lawyer cannot file, defend or plead on your behalf before Dubai Courts without a notarised power of attorney. You may represent yourself in person without one.

Can I revoke a court case POA?

Yes, through a notarised revocation. The agent and the court should be notified so the revocation takes effect on the case file. Our guide to the legal notice for cancellation of a POA explains the steps.

Is a UAE POA valid abroad?

Only after legalisation by the UAE Ministry of Foreign Affairs and the embassy of the destination country — the UAE is not party to the Apostille Convention. See our guide to international powers of attorney.

Either directly — log in to the Dubai Courts portal or app with UAE PASS, upload the Arabic draft, pay the fee and attend the notary session — or through a licensed private notary service that drafts, translates and books the session for you. Both routes end with the same Dubai Courts notarisation.

How much are court fees in the UAE?

Court fees are separate from the POA notary fee. In Dubai they are governed by Law No. 21 of 2015 and are generally a percentage of the claim value within a minimum and maximum, varying by case type. They are paid to the court when the claim is filed.
